The court highlighted that such facilities are necessary to maintain mothers’ privacy and provide significant benefits to infants. Additionally, the court suggested that these provisions should be included in government buildings under construction.

The Supreme Court has directed the central government to ensure that these guidelines are implemented by the states within two weeks. The court specifically focused on the need for designated areas in government buildings where mothers can breastfeed their babies, ensuring privacy for both the mothers and their children.

Justices B.V. Nagarathna and Prasanna B. noted that providing such facilities would guarantee privacy for mothers and be beneficial for the infants. The court also urged the state governments to set up similar provisions in existing public spaces where possible.

Action in Under-Construction Government Buildings

The bench also directed that adequate space be allocated in under-construction government buildings and other governmental areas to set up breastfeeding facilities. The Supreme Court had been hearing a petition seeking the establishment of rooms for breastfeeding and child care in public places.

A letter from the Ministry of Women and Child Development was submitted on February 27, 2024, which had been sent to the Chief Secretaries of all states and Union Territories, along with instructions to implement these recommendations.

Privacy and Protection for Mothers

The court expressed satisfaction with the inclusion of these demands in the letter sent by the Ministry’s Secretary. It noted that implementing these recommendations would ensure the privacy of young mothers and their babies during breastfeeding.

The court also directed that the central government send a reminder to the Chief Secretaries of all states and Union Territories within two weeks to ensure compliance with the court’s directives.
