Anyone who violates the child adoption laws will be jailed for three years or fined up to one lakh rupees. If non-governmental organizations or orphanages work against this law, those found guilty will be jailed for 3 years, or fined up to one lakh rupees, and their license will be revoked for a year.

If the children are adopted and sold, those who do so can be imprisoned for five years and fined up to one lakh rupees. If hospitals and nursing homes are involved in such illegal activities, those responsible may be jailed for up to seven years. Similarly, if an adopted child is physically or mentally assaulted, they will also be punished with imprisonment for three years and a fine of one lakh rupees.

According to the Juvenile Justice Act, a child can be adopted from any caste, even if they are strangers. But the rules of Central Adoption Resource Authority or State Adoption Resource Authority should be followed.

According to the provisions of Section 56 to 73 of the Juvenile Justice Act Chapter 8, only a couple can adopt a child. Couples are also considered only if both consent. This act also allows adoption only if they are confident that they can raise the child in a good environment financially, physically and mentally. Not only single parents, NGOs can also adopt, but such NGOs and orphanages must be officially registered.

A child can be adopted under either of these two acts. Legal experts say that so far there has been no conflict between these two acts. There are certain rules that must be followed in order to adopt a child. Children can be adopted in India under the Juvenile Justice Act and Hindu Adoption Acts. These should be followed as per Hindu Adoption Act.

However, the act only allows Hindus to adopt relatives’ children. If a male child wants to adopt a female child, there should be a 21-year age difference between the two. Even if a woman wants to adopt a boy there should be a 21 year age gap between them. The adopters should be in a position to take care of the child mentally and financially.

Adopters must also be the child’s own parents or guardians. Once a child is adopted, only the adoptive parents have rights over the child. But whatever properties and gifts are given to the child before adoption, they belong to the child.
